Secondly, McCain is a public figure. Public figures have the same protections against defamation as private people do. In order for him to sue successfully, he would have to prove that what the Times was false, that the Times knew it was false at the time it was published, that the Times published it with gross disregard for the truth, and the Times intended to maliciously harm McCain by the publication. Then McCain would have to prove that harm did, in fact, come from the publication.
There is no way on McCain could meet that standard. He cannot show that each and every person that voted against him in the general election did so only because of this publication.
